QUESTIONS
The constitutional lawyers at Tyler & Bursch, LLP, The National Center for Law & Policy, and their clients agree that people have as much a right to assemble to protest as they do to assemble in church. However, the County’s hypocrisy on whose First Amendment right is worthy of protection is glaring.
Pastor Mike McClure stated the following: “Our goal as pastors is to help people, especially when they are hurting, and bring the gospel of Jesus Christ to a lost and dying world. With the world hurting today, like I haven’t seen before, it’s the Good News and prayer that the church brings that can heal our land. He then added, “I pray that our leaders will see that the church, which has started the hospitals and universities in this country, is the most essential entity to solve the problems our society is facing today.”
In another act of religious discrimination and government overreach, the County Orders require “Small Outdoor Ceremonies and Religious Gatherings” to “maintain a list with the names and contact information of all participants” and “assist the County Public Health Department in any case investigation and contact tracing associated with the gathering.”

PROPOSITIONS & ARGUMENTS
The County Order also states, “Failure to comply with any of the provisions of this Order constitutes an imminent threat and menace to public health, constitutes a public nuisance, and is punishable by fine, imprisonment, or both.” No other activities or gatherings, including large public protests with possibly hundreds or even thousands of participants from outside the community, are required to maintain such a list.
Robert Tyler, Partner at Tyler & Bursch, LLP had this to say, “Santa Clara County’s order banning indoor church services and requiring pastors to hand over lists of people who attend church is a gross abuse of power. If it goes unchecked, we will see more of this type of behavior by government and more ground being taken away.”
